These general terms and conditions of sale (GTC) exclusively govern the contractual relations between ValTherm and any person (hereinafter referred to as “customer,” “member,” “user,” “you,” or “buyer”) who places an order on the ValTherm website (hereinafter referred to as « the website »).

By using the ValTherm website, you acknowledge that you have read and understood the following GTC and agree, without reservation, to be bound by them.
The choice and purchase of a product or service (activities, subscriptions) are the sole responsibility of the customer.
The main features of the products and services offered are described and presented as accurately as possible on the ValTherm website.. The customer is required to take note of this information before placing an order. However, if errors or omissions occur in this description, ValTherm cannot be held liable.

General Provisions

These GTC apply to all sales of services (membership, activities) or items made through the ValTherm website and are an integral part of the contract between the buyer and ValTherm.

ValTherm reserves the right to modify these terms at any time without prior notice by publishing a new version on its website.
Therefore, we encourage you to review these GTC each time you visit the ValTherm website. The date indicated at the end of this page provides information on their last update.

The GTC in force at the time of payment for the order will apply.

ValTherm’s Obligations

ValTherm undertakes to implement all necessary technical and human resources to provide the services offered.

ValTherm undertakes to comply with the terms of the contract concluded with its customer in accordance with federal and provincial laws.

Customer’s Obligations toValTherm

The customer must respect the friendly and collaborative atmosphere of ValTherm. The customer must also show respect to other members and refrain from making disparaging remarks about them or ValTherm.

The customer agrees to provide ValTherm with complete and accurate information, in French or English, necessary for the proper execution of the purchase contract, such as name, first name, address, etc. The customer also agrees to inform ValTherm of any change in their contact information.

The customer agrees to pay the full price requested by ValTherm. Any order placed with ValTherm (purchase of items) constitutes acceptance of these GTC. The buyer has the opportunity to review the details of their order and correct any errors. Before confirming the order, a summary is presented with the details and the total price including taxes. The buyer has the option to modify their shopping cart. Once the buyer confirms their order, it is considered that they have accepted the contents and conditions of the order, including these GTC, the price, and the membership conditions. The sale will be final upon payment acceptance.

By purchasing from ValTherm, the customer releases ValTherm, its members, and any person officially associated with ValTherm from any liability for accidents or damages of any kind that may result from the operation and handling of ValTherm‘s water heater.

Ordering Items

ValTherm Items

The purchase of items in the ValTherm website’s shop is open to all customers, whether they are members of ValTherm or not.

ValTherm has selected quality items bearing the ValTherm logo.

Moreover, on the website, each item includes a description as precise as possible as well as measurements corresponding to the sizes to be ordered.

Delivery of ValTherm Items

Each item is carefully inspected by the order manager upon receipt in stock and during the preparation of your order.

Payment

The prices displayed on the ValTherm website are in Canadian dollars.

Only one type of payment is accepted

  • Secure online payment.

Payments on the ValTherm website are made through Stripe, a specialized site for processing online payments for e-commerce, which accepts all major debit and credit cards from all countries (Visa, MasterCard, American Express, etc.). It is not necessary to have a Stripe account to make a payment; only your card data is required.

ValTherm has chosen a specialized online payment provider, Stripe, to ensure security in payment transactions. Payment by Stripe is compliant with PCI-DSS rules and the highest security standards for online payments (HTTPS and HSTS for secure connections). ValTherm does not store any of your financial data on its servers.

ValTherm reserves the right to change the provider for online payments or the payment methods allowed on its site without prior notice.

Payment Default

For secure online payment, there can be no default of payment because it is validated or not during the payment process on Stripe.

Access Restrictions

ValTherm reserves the right to suspend or cancel a user’s profile, at its sole discretion and without notice, at any time. ValTherm also reserves the right to restrict a user’s access to the website, in whole or in part. ValTherm cannot be held responsible for such suspension, cancellation, or restriction.

Force Majeure

ValTherm will not be responsible for the non-performance, in whole or in part, of any of its obligations to its customers, nor for the damages or losses that its customers may suffer, if the non-performance, damages, or losses result from a case of force majeure or circumstances beyond its control.

Trademark and Copyright

This website and its content are the property of ValTherm and are protected by copyright laws in Quebec, Canada, and under applicable international conventions. You do not have the right to use or reproduce the information contained therein.

Choice of Domicile and Applicable Laws

These GTC and the purchase and sale operations resulting from them are governed by the laws applicable in the province of Quebec and Canada. They are written in both French and English.

The parties (the customer and ValTherm) agree that for any claim or lawsuit of any kind relating to the performance and interpretation of these GTC, they will choose the judicial district of Montreal in the province of Quebec, Canada, as the appropriate venue for hearing such claims or lawsuits, to the exclusion of any other judicial district that may have jurisdiction over such a dispute under the provisions of the Law.
